Terms of Commission

-Payment and refunds of payment-

For auction based commissions, I will only offer partial payment up front for anyone with 10 or more positive feedback. Anyone with less than 10 can contact me and inquire about partial payment up front.

I take direct Paypal, Credit Card and bank transfers
Postal Money orders, US only
Personal Checks, though I wait for checks to clear before finishing work
Cash, at buyer's risk. I hold no responsiblity if cash doesn't reach me

When the agreed upon portion of payment is received (Either payment in full, or partial payment up front) work will begin, nothing beyond an initial sketch will be completed until payment is received. As a rule, once work has started on the commission, a FULL refund is not available, the more work that has gone into the commission, the more payment I take out of the refund.

If the commissioner fails to pay in any manner, I hold the right to alter and resell the art at my discretion. The commissioner, however will be informed ahead of time of this action, so they may correct nonpayment. No rights to characters in use will be sold and credits will still be given as to ownership of the characters.

-Making changes to the art during a commission-

I usually have no issues with small changes to a commission once the inital sketch is satisfactory. It is up to my discretion if changes asked for are of reasonable and fair request. Major changes to a character while in commission are possible, but additional payment may be discussed for these changes. I have a limit of THREE (3) changes made to the initial sketch before additional costs apply. In other words, be very clear in what you want, or be willing to negotiate.

-Communication-

Please make an effort to respond to emails about commissions promptly. If you do not reply to me with how you feel about progress, I can not continue in a prompt manner myself. Commissioners that take expended periods to reply to these progress emails, will be moved to the bottom of the commission queue, to allow me to work on other art.

I make a large effort to keep the commissioner updated on art, you have the right to contact me at any time with questions or inquires about a commission.

-Rights of use-

The commissioner (you) retain all rights to characters of your own creation if used within the commissioned work. The commissioner retains rights to repost the works commissions for a NON profit manner, with no need for credit given. They may not however, claim rights to the art. The right to reprint the art is NOT part of these rights, this includes but is not limited to: Artwork prints, book covers, game books, CD covers. In other words, this is a personal piece of art, not a commercial commission.

I retain the right to repost the art here, on my personal web site, along with possibly Deviantart.com, or other art archives. You may request to have a watermark added to commissioned work. I also retain the right to reuse art as part of a personal portfolio, or as examples for future commissions.

Unless agreed upon, no prints will be made of commissioned art. If agreed on, commissioner can request a number of prints be given to them, at the cost of shipping. Only a limited run of prints would be made of commissioned work.
